Disclosure in Terms of the National Credit Act, 2005 (Act No. 34 of 2005)

In accordance with the provisions of the National Credit Act, 2005 (Act No. 34 of 2005) and its accompanying regulations, particularly Regulation 18(4) read together with Section 70(2)(g), the consumer credit information included in any trace or investigative search conducted by Simply Solitude is accessed strictly for one or more of the following prescribed and lawful purposes:

  • The detection, investigation, or prevention of fraud, corruption, or theft, provided such investigation is being conducted by the South African Police Service or another statutory enforcement agency;
  • The provision of fraud detection and fraud prevention services;
  • Evaluating a candidate for employment in a role that requires honesty and integrity and involves the handling of cash or financial responsibilities, with the prior written consent of the consumer;
  • Conducting an assessment of a business’s debtors book for the purposes of:
    • A potential sale of the business or its debtors book;
    • Any transaction that relies on accurately determining the value of the business or its debtors book;
  • Establishing a service provision limit for ongoing services, with the prior written consent of the consumer;
  • Assessing applications for insurance, with the prior written consent of the consumer;
  • Verifying academic qualifications and employment history, with the prior written consent of the consumer;
  • Locating consumers in order to facilitate the distribution of unclaimed funds, such as pension benefits or insurance payouts;
  • Tracing consumers by a credit provider in connection with a credit agreement entered into between that consumer and the credit provider;
  • The development of a credit scoring model or system by a credit provider or registered credit bureau.

Furthermore, in compliance with Regulation 18(6)(d), the consumer in question has granted specific and informed consent for their credit information to be used for a non-credit-related purpose, as defined by and permitted under the National Credit Act.
